Agreement to Terms

By accessing or using Timedletter (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. You must be at least 18 years old to use this Service.
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through a notice on our Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

Timedletter is a timed message delivery and digital legacy platform that allows users to:
- Write and store encrypted messages, letters, and instructions for designated recipients
- Configure a recurring email check-in on a frequency they choose from the set the Service offers
- Set a delivery delay on each message, so that the message is delivered once that delay has elapsed from a missed check-in
- Schedule a message for an exact date, independently of check-ins
Timedletter is a communication and delivery service, not a legal document executor. The Service is designed to only supplement a formal will, trust, or other legal instrument. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

To access the Service, you must register with a valid email address, username, and secure password. You agree to provide accurate, current, and complete information and to keep your account email address up to date, since check-in requests are sent there.
You are responsible for maintaining the confidentiality of your credentials and all activity under your account. You may not share credentials, allow others to access your account, create multiple accounts for abusive purposes, or use another user's account without permission.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, abuse the Service, or if we are required to do so by law.

The Service is sold as lifetime access for a single payment, processed securely through Stripe. There is no recurring charge, nothing renews, and there is no subscription to cancel.
We may change the price of lifetime access at any time. A change never affects a purchase you have already made.
You may request a refund of lifetime access within 14 days of purchase, and we will refund it in full to your original payment method. After 14 days, refunds are at our discretion. This does not affect any statutory refund rights you hold where you live. Report disputed charges to [email protected] within 30 days.
Without lifetime access you may write, edit, and schedule messages, but no message is delivered to a recipient and no check-in reminder is sent to you. Both delivery and check-in reminders require lifetime access at the time the message becomes due.

Your message content remains your property. By using the Service, you grant us a limited license to store, encrypt, and transmit your content solely to fulfil your delivery instructions. You may not copy, modify, reverse engineer, or create derivative works of the Service itself, or use it to build a competing service.
If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use and incorporate that feedback without compensation.

You agree not to use the Service to violate applicable laws, harass or threaten recipients, transmit hate speech, sexually explicit material, fraudulent instructions, or illegal content, impersonate any person or entity, send unsolicited bulk communications, attempt unauthorized access, use automated scraping tools, or circumvent usage limits or payment requirements.
Violations may result in a warning, temporary suspension, permanent termination, or legal action. Report violations to [email protected].

You are responsible for correctly configuring your check-in frequency and each message's delivery delay, and for keeping your account email address up to date. Confirming a check-in resets your check-in clock and moves every delivery date back. If you miss a check-in, each message is delivered once its own delivery delay has elapsed from that missed check-in. You may pause check-ins at any time from your dashboard; while paused, we send no check-in emails and no message is delivered on the missed check-in clock, though messages set for an exact date are still delivered on that date. Resuming a paused account starts your check-in clock again from the moment you resume. Timedletter is not liable for unintended deliveries caused by your failure to respond to check-in notifications that were successfully sent to your account email address.

The Service integrates with Stripe (payments), Resend (email delivery and check-in notifications), and cloud hosting providers. Your use of third-party services is subject to their own terms and policies. We are not liable for unavailability, errors, or failures of third-party services.

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that messages will be delivered if recipient contact details are outdated, that the Service constitutes a valid legal instrument, or that it will meet all your legacy planning needs without supplementary legal advice.
To the maximum extent permitted by law, Timedletter shall not be liable for indirect, incidental, special, or consequential damages. Our total liability for direct damages shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

You agree to indemnify and hold harmless Timedletter and its officers, directors, employees, and agents from any claims arising from your use or misuse of the Service, violation of these Terms, content you store or transmit, claims by recipients arising from your configured messages, or your reliance on the Service as a substitute for formal legal estate planning.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Timedletter. If any provision is found unenforceable, the remaining provisions remain in effect. You may not assign your rights without our prior written consent. We are not liable for delays due to circumstances beyond our reasonable control. By using the Service, you consent to receive electronic communications from us.

You may terminate your account via account settings or by contacting support. We may terminate or suspend your account immediately for breach of these Terms, fraudulent activity, legal requirements, or extended inactivity. Upon termination, access ceases immediately and check-ins stop. Delete any message you do not want delivered before you terminate, including messages set for an exact date. You may request deletion of your data by contacting [email protected].
